Law on urgent measures in the field of income containment

- 1- The new law affects all contracts from 09/22/2020
2-It affects all contracts that are intended for the landlord’s permanent residence.
3- Price restrictions will not affect the entire region of Catalonia. Only leases related to houses located in areas declared as “tight housing markets” are subject to the income restriction system.

- Badalona, Barberà del Vallès, Barcelona, Blanes, Calafell, Castellar del Vallès, Castelldefels, Cerdanyola del Vallès, Cornellà de Llobregat, Esplugues de Llobregat, Figueres, Gavà, Girona, Granollers, L’Hospitalet de Llobregat, Igualada, Lleida, Manlleu, Manresa, Martorell El Masnou, Mataró, Molins de Rei, Montcada i Reixac, Montgat, Olesa de Montserrat, Olot, Palafrugell, Pallejà, Pineda, El Prat de Llobregat, Premià de Mar, Reus, Ripollet, Rubí Sabadell, Salou, Salt, Sant Adrià de Besòs, Sant Andreu de la Barca, Sant Boi de Llobregat, Sant Cugat del Vallès, Sant Feliu de Guíxols, Sant Feliu de Llobregat, Sant Joan Despí, Sant Just Desvern, Sant Pere de Ribes, Sant Vicenç dels Horts, Santa Coloma de Gramenet, Santa Perpètua de Mogoda, Sitges, Tarragona, Terrassa, Tortosa, El Vendrell, Vic, Viladecans, Vilafranca del Penedès, Vilanova i la Geltrú and Vilassar de Mar.
4- The following are excluded from the rule:
- Homes rented before January 1, 1995
- Homes subject to an official protection regime
- Housing intended for social rental.
5- The income from the contracts of this law must be the amount indicated in the following calculation, which is determined as follows:

- In the event that this property has been rented at some point in the last 5 years, the price to be taken into account will be the rent agreed in that contract.
- Of the 2 values, the lower price will be taken.
- The reference price may include municipal tax expenses and community expenses.
6-What should I do if the house is new?
- For newly built houses or houses that have undergone major renovation procedures, the upper area of the reference index could be taken.
7- What happens if I ignore the law?
Administrative sanctions classified as serious may be imposed, ranging from €3,000 to €90,000.
In addition, the tenant has the right to request a refund of the overpaid fees.
